Family Immigration

Under certain circumstances, family members may obtain permanent residency or be admitted to the United States along with a family member.

PERMANENT RESIDENCY

A United States citizen may petition for the following foreign national relatives to immigrate to the United States:

o Husband or wife;

o Unmarried child under 21 years old;

o Unmarried son or daughter over 21;

o Married son or daughter of any age;

o Brother or sister, if you are at least 21 years old; or

o Parent, if you are at least 21 years old.

A lawful permanent resident may petition for the following foreign national relatives to immigrate to the United States:

o Husband or wife; or

o Unmarried son or daughter of any age.

To be eligible for lawful permanent residence based on a family relationship the following criteria must be met:

* You must have a relative who is a United States citizen or a lawful permanent resident of the United States who can provide documentation proving their status and is willing to sponsor the applicant for lawful permanent residency.

* The relative must prove they can support the applicant by providing documentation that their income is 125% above the mandated poverty line for their family, including the applicant and all other sponsored family members.

NONIMMIGRANT FAMILY MEMBERS

Those admitted to the United States on a temporary basis may be able to bring family members with them. This permission varies depending upon the category under which the foreign national was admitted.

FIANCE PETITIONS

A fiancé (e) is a person who is engaged or contracted to be married. The marriage must be legally possible according to laws of the state in the United States where the marriage will take place. American citizens who wants to marry his/her foreign fiancé (e) in the United States must file a Petition for Alien Fiancé (e) in the United States with USCIS.

MARRIAGE VISAS

The K3 visa for the spouse of a United States citizen and K4 visa for the spouse’s children were created to reduce the separation between a US citizen and his or her foreign spouse while waiting abroad for an immigrant visa. The K3 and K4 visas allow the foreign spouse and his or her children to enter the United States as non-immigrants, re-unite with their family here, and then apply for permanent resident status (Green Card) while in the United States.
